The frozen Russian assets are mainly in Europe and managed by the Belgian Euroclear.

It is probably not possible to seize them just like that since all attempts will be legally contested. If the decision is then overturned by a court and the assets are returned, the volume of assets is so extensive that Euroclear and thus the banking systems in Europe would falter (not to mention Belgium).

So it probably requires, for example, a ruling from some internationally recognized authority or a binding decision from the UN or consent from Russia in order to be able to “take” the assets. That is, a solid legal basis. Anything else would risk seriously damaging the financial systems.

The proposal to use Iranian assets that have been frozen suffers from the same fundamental weakness. But there may still be openings if it concerns funds frozen in countries that have been attacked by Iran. There, one can argue a right to compensation to remedy the damages caused by Iran. And then one can of course hope that Iran is so weak and financially isolated that it does not matter if the assets are seized – after all, they have started a war to overthrow the regime, and then the seizures can be seen as part of the warfare.
